Daniel McCaffery

Judge Daniel McCaffery is a current Judge on the PA Superior Court since 2019.  McCaffery attend West Point Academy, and served in the U.S. Military, attending Temple Law on a veteran’s scholarship after his honorable discharge.  McCaffery began his legal career at the District Attorney’s Office where he practiced from 1991-1997.  In 1997, he joined the firm of Jaffe, Friedman, Schuman, Nemeroff and Applebaum PC as part of their commercial litigation practice group.  In 2003 he was elected to the Court of Common Pleas in Philadelphia.

McCaffery has centered his campaign on the need for strong voice for democracy on the Commonwealth’s highest court.  His campaign website states “Democratic institutions including the judiciary are under duress. These attacks have undermined the confidence of the American public in our courts. If elected (his) priority will be to approach every case in a non-partisan manner. (He) will use (his) best efforts to restore faith in the judicial branch of government. (PA Bar Association Questionnaire). Also, importantly, he believes that the constitution is a “living document” (PADems Women’s Forum) and that many of our rights are under attack especially in view of the Dobbs decision and the Supreme Court’s “originalism” approach to constitutional interpretation and its limited view of rights that has been supported by substantive due process. Calls “independent state legislature theory” a “crackpot” idea. (PADems Women’s Forum).
